Terms of Service
1. General Provisions
1.1. This document constitutes a public offer in accordance with Article 437 of the Civil Code of the Russian Federation.
1.2. Acceptance of this offer is constituted by the user's registration with the FL Mafia service and/or payment of the subscription.
1.3. The FL Mafia service is a desktop application for Windows and macOS that provides access to digital content and additional functionality on a subscription basis.
1.4. By using the service, the user confirms agreement with all terms of this agreement.
2. Subject of the Agreement
2.1. The Operator grants the user a non-exclusive, limited, revocable license to use the service and the digital content hosted therein, within the scope provided by this agreement.
2.2. Access to functionality and content is provided on a paid subscription basis.
2.3. The specific set of available features is determined by the chosen subscription plan.
3. Registration and Account
3.1. To use the service, the user must create an account.
3.2. The user agrees to provide accurate information.
3.3. The user is independently responsible for maintaining access to their account.
3.4. The user is responsible for actions performed through their account.
4. Subscription and Payment
4.1. Access to the service is provided on a monthly subscription basis.
4.2. The subscription renews automatically unless the user cancels it through their account dashboard before the next billing date.
4.3. The user may cancel the subscription at any time. After cancellation, access to the service remains until the end of the paid period.
4.4. Subscription pricing is listed on the website flmafia.app.
4.5. Payments are processed through third-party payment providers. The Operator does not store full bank card details.
5. Refunds
5.1. The user may submit a refund request within 3 calendar days from the date of the charge.
5.2. The request should be sent to the Operator via email.
5.3. Refunds are available provided there has been no abuse of the service functionality.
5.4. Refund decisions are made by the Operator on a case-by-case basis.
5.5. In cases of bad-faith use of the service (mass downloading of content followed by a refund request, etc.), the refund may be denied.
6. Digital Content and License
6.1. The service provides the user with access to digital materials for music production, including but not limited to:

audio samples, loops, and beats
-
drum kits
-
MIDI files
-
presets and synthesizer banks
-
software plugins
6.2. Right of Use. The user may use the obtained materials in their own musical works, including:

modification and integration into music, audio productions, and other projects;
-
distribution of works created using the service's materials.
6.3. Separate License for Royalty-Free Materials. For materials marked as royalty-free in the service, the user receives a separate license document (PDF) confirming the right to use such materials. This document is generated and provided to the user upon clicking the "Get License" button next to a specific audio sample.
6.4. Liability for Licensing.
6.4.1. The Operator confirms that when providing materials marked as royalty-free, it has obtained the appropriate rights or licenses from the copyright holder for their distribution and transfer to users under the terms of this agreement.
6.4.2. If it is discovered that materials indicated as royalty-free were provided to the Operator in violation of third-party rights, liability for such violations lies with the party that provided such materials to the Operator.
6.4.3. The user is independently responsible for compliance with copyright and other third-party rights when using any materials, including their integration into their own works.
6.5. No Guarantees Regarding Matches. The Operator does not guarantee that the use of materials, including samples and MIDI files, will not result in matches with third-party works when using third-party recognition, analysis, or distribution services.
7. User-Generated Content (UGC)
7.1. By posting their own content on the service, the user guarantees that they have all necessary rights and licenses for such materials.
7.2. By posting content, the user grants the Operator a non-exclusive right to store, distribute, and display this content within the service.
7.3. In the event of content uploaded in violation of third-party rights, the Operator may:
- remove the respective content;
- suspend user access;
- require the user to resolve third-party claims.
8. "Connects" Section
8.1. The FL Mafia service includes a "Connects" section, which is an informational catalog of artists and musicians.
8.2. The "Connects" section contains the following information:

artist name or stage name;
-
links to public social media profiles;
-
public contact information (if publicly shared by the artist);
-
other information available from public sources.
8.3. The "Connects" section is not a messenger, intermediary platform, or communication facilitation service. The FL Mafia service does not participate in correspondence between users and artists and does not provide tools for mass messaging.
8.4. Information in the section is compiled based on publicly available data.
8.5. The Operator does not guarantee the accuracy, completeness, or reliability of the posted information.
8.6. The user independently decides to interact with artists and is responsible for how they use the obtained contact information.
8.7. If an artist or rights holder submits a substantiated request for information removal, the Operator may remove the respective data.
9. AI Assistant
9.1. The service may provide access to artificial intelligence functionality to assist the user.
9.2. Results obtained from the AI assistant are informational in nature and do not constitute professional recommendations.
9.3. The Operator does not guarantee the absence of errors, discrepancies, or other issues in AI output.
10. Referral Program
10.1. Within the referral program, the user may receive bonus rewards for attracting new users to the service.
10.2. Bonus accrual is carried out in accordance with the referral program rules published on the service.
10.3. Accrued bonuses are displayed in the user's account dashboard.
10.4. The user may request payout of accrued rewards at any time, subject to referral program conditions.
10.5. In the event of restriction or termination of the user's access to the main application functionality:

the user's participation in the referral program is preserved;

bonus accrual may continue in accordance with program rules;
-
previously accrued and newly accrued amounts may be withdrawn by the user;
-
access to accrual information and withdrawal functionality may be provided through the account dashboard and/or other means provided by the service (including via Telegram bot).
10.6. The FL Mafia service is not a financial organization and does not provide payment or banking services. Bonus reward payouts are made within the loyalty program framework.
11. Grounds for Access Restriction
The Operator may restrict or terminate the user's access to the service in case of:
- violation of the laws of the Russian Federation;
- posting of prohibited materials, including extremist content or content infringing third-party rights;
- repeated violations of this agreement.
12. Limitation of Liability
12.1. The service is provided on an "as is" basis.
12.2. The Operator does not guarantee uninterrupted operation of the service.
12.3. The Operator's maximum liability is limited to the subscription amount paid for the last billing period.
12.4. The Operator is not liable for the actions of third parties.
